Status Hukum Jual Beli Padi Basah Dengan Padi Kering: Perspektif Fiqih Muamalah

This study examines the practice of exchanging wet paddy for dry paddy in Rejo Agung Village, Tegineneng District, Pesawaran Regency, from the perspective of fiqh muamalah. This practice emerges from the economic needs of farmers and the limitations of post-harvest facilities, particularly drying infrastructure. The research employs a qualitative field research approach using observation, semi-structured interviews, and documentation, involving four key informants selected through purposive sampling. The findings reveal that although the transaction is conducted based on mutual consent and direct exchange (taqabudh), it fails to meet the principle of equality (tamatsul) due to the absence of standardized measurement of moisture content. Scientifically, wet paddy contains higher moisture levels, resulting in weight shrinkage after drying, which creates uncertainty in determining the actual value at the time of the contract. This condition constitutes significant uncertainty (gharar fahish) and potentially leads to riba al-fadl, as the exchange involves ribawi commodities of the same type with unequal quantities. From a fiqh muamalah perspective, the practice is legally problematic and tends to be invalid as it resembles the prohibited transaction of muzabanah. Therefore, this study emphasizes the need for reconstructing local transaction mechanisms through moisture standardization, the use of measurement tools, and the transformation into monetary-based transactions. These findings contribute to the development of applied Islamic economic law in rural agricultural contexts.
